This document constitutes a legally binding agreement between you and ICITECH Teknoloji (“HIJO.AI,” “we,” “our,” or “us”) governing your access to and use of our platform, services, and website located at https://hijo.ai (collectively, the “Platform”). By accessing, using, registering for, or interacting with our Platform in any way, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions, our Privacy Policy, and any other policies or guidelines we post on the Platform.
Please do not use the Platform if you do not accept these Terms. Continued use after any modifications to these Terms shall indicate your acceptance of those changes. We reserve the right to revise these Terms at any time without notice. It is your responsibility to regularly review these Terms for any updates or modifications.
The Platform is intended solely for business use by authorized users and entities. You represent that you are of legal age to enter into binding agreements and are not a person barred from receiving services under the laws of your jurisdiction.
Platform Ownership and Intellectual Property
All materials, content, functionality, design elements, software code, text, images, video, graphics, user interface, databases, and data structures on the Platform are either owned by ICITECH Teknoloji or licensed to us. This includes but is not limited to the “HIJO.AI” brand, logos, visual identity, product architecture, and underlying technology. The entire content of the Platform is protected by international copyright, trademark, trade secret, and other intellectual property laws.
Except as expressly permitted in writing, you may not copy, modify, create derivative works of, distribute, license, reverse-engineer, disassemble, transmit, publish, or exploit any portion of the Platform or our services. Use of our intellectual property without explicit authorization is strictly prohibited.
User Accounts and Access
To access certain features of the Platform, you may be required to create an account. When registering, you agree to provide complete, accurate, and current information, and to maintain that information accordingly. You are solely responsible for safeguarding your account credentials, and you assume full responsibility for all activity under your account. If you suspect any unauthorized use of your credentials or breach of security, you must notify us immediately.
We reserve the right to suspend, restrict, or terminate your access to the Platform at any time, with or without cause, including without limitation, violations of these Terms, fraudulent or abusive behavior, or activities that may harm us or other users.
Permitted and Prohibited Use
You may use the Platform only in compliance with applicable laws and regulations. You agree not to use the Platform in any manner that could harm, disable, overburden, or impair the Platform, our systems, or other users’ experience. Prohibited uses include, but are not limited to: unauthorized access or use of data, interfering with security-related features, deploying malicious code or exploits, reverse engineering our software, harvesting information about other users, impersonation, posting harmful or unlawful content, or using the Platform for illegal activities or in violation of third-party rights.
You agree not to upload or transmit any content that infringes upon intellectual property rights, violates data protection laws, is defamatory, harassing, obscene, fraudulent, or otherwise objectionable.
User Content and Responsibility
If you provide or upload any content, data, or materials to the Platform—including, but not limited to, feedback, suggestions, support requests, messages, or operational data—you grant us a non-exclusive, worldwide, royalty-free, transferable license to use, display, modify, adapt, store, reproduce, distribute, and sublicense such content for the purposes of operating and improving the Platform. You represent and warrant that you own or have the necessary rights to share such content and that it does not violate any third-party rights.
We reserve the right (but not the obligation) to monitor and remove any content or user activity that, in our judgment, violates these Terms or applicable law.
Subscription, Payment, and Services
If the Platform or any part of our services is offered under a paid subscription, billing and access will be governed by the specific terms presented at the time of registration or upgrade. Subscriptions may be billed monthly or annually, and fees are non-refundable unless otherwise stated.
If you fail to make payment for services, we may suspend or terminate your access without notice. Additional features or integrations may be subject to separate licensing or commercial agreements.
Third-Party Services and Integrations
Our Platform may integrate or interoperate with third-party services such as Firebase, Google Analytics, RevenueCat, OneSignal, or Amazon Web Services (AWS). These services may collect, store, or process your data under their own terms and privacy policies. While we make reasonable efforts to ensure compliance with applicable data protection standards, we do not control and are not responsible for the practices of third parties.
You acknowledge and agree that use of third-party features is at your own risk and that you are responsible for reviewing those third-party terms.
Data Protection and Privacy
Our handling of personal data is governed by our Privacy Policy, which is incorporated by reference into these Terms. We adhere to data protection principles under GDPR, CCPA, and KVKK. By using the Platform, you consent to the collection and processing of your personal and operational data as outlined in the Privacy Policy. We only retain data for as long as necessary to fulfill legal or operational purposes.
You understand and agree that performance cookies and tracking tools may be used to improve our services. No sensitive personal data is collected without your consent.
Disclaimers
THE PLATFORM IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND. WE EXPRESSLY DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND AVAILABILITY. WE DO NOT WARRANT THAT THE PLATFORM WILL BE ERROR-FREE, UNINTERRUPTED, OR FREE OF VIRUSES OR HARMFUL COMPONENTS.
Your use of the Platform is at your own risk. We are not responsible for any damages, loss of data, or financial losses resulting from system errors, user actions, third-party integrations, or downtime.
Limitation of Liability
To the maximum extent permitted by law, ICITECH Teknoloji, its affiliates, directors, officers, employees, contractors, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Platform. Our total liability for any claims related to the Platform shall not exceed the amount you paid us in the twelve (12) months preceding the claim.
Indemnification
You agree to defend, indemnify, and hold harmless ICITECH Teknoloji and its representatives from and against all claims, liabilities, damages, losses, and expenses (including legal fees) arising out of or related to your use of the Platform, violation of these Terms, breach of data or intellectual property rights, or misconduct.
Governing Law and Jurisdiction
These Terms are governed by and construed in accordance with the laws of the Republic of Turkey, without regard to its conflict of law provisions. Any disputes arising from or related to these Terms or the Platform shall be subject to the exclusive jurisdiction of the courts located in İstanbul, Şişli.
Termination
We reserve the right to terminate or suspend your access to the Platform at our sole discretion, with or without notice, for conduct that we believe violates these Terms or is harmful to other users or us.
Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and ICITECH Teknoloji regarding your use of the Platform, and supersede any prior or contemporaneous understandings or agreements.
